Title IX Amendments Released, Effective August 1, 2024

Today, the U.S. Department of Education released its long-anticipated amendments to the regulations implementing Title IX of the Education Amendments of 1972 (“2024 Amendments”). The 2024 Amendments, which go into effect on August 1, 2024, introduce substantial changes aimed at enhancing protections for students, employees and others and ensuring fairness in the handling of allegations of sex-based discrimination and harassment in educational settings.

Among the myriad of subjects addressed by the 2024 Amendments are scope of Title IX, the provision of supportive measures, the adoption and implementation of grievance procedures, and the provision of training to employees. As anticipated, the 2024 Amendments also include new provisions designed to protect students, employees and other members of the educational community from discrimination based on sexual orientation, gender identity, sex stereotypes, sex-based characteristics, and pregnancy and related conditions.

Along with the Amendments, the Department of Education has released a fact sheet, summary of major provisions, and resource guide on drafting policies and procedures which are available for public viewing.
