FOIA and OMA Changes Signed into Law

On November 21, 2025, Governor Pritzker signed Senate Bill 0243 into law as P.A. 104-0438, ensuring that key changes to the Open Meetings Act and Freedom of Information Act take effect on January 1, 2026. Among other things, the amended laws expand the permissible reasons for remote attendance at meetings, restrict public bodies from holding regular or special meetings on any election days, limit how electronic FOIA requests may be submitted, and allow public bodies to verify that a request was submitted by a person.
Public bodies should begin reviewing their respective policies and procedures in anticipation of these changes.
